1. Use of the App

HoldFast is licensed for personal, non-commercial use on Apple devices you own or control. You agree not to:

• Reverse engineer, decompile, or modify the app
• Use the app for any unlawful purpose
• Attempt to gain unauthorised access to any server or system connected to the app

2. Safety Disclaimer

HoldFast is designed to assist with anchor watch but is not a substitute for proper seamanship. GPS accuracy can be affected by signal conditions, device limitations, and environmental factors. You acknowledge that:

• The app may not detect drag in all conditions or with perfect accuracy
• Alarms may fail due to device battery failure, GPS signal loss, software errors, or other factors outside our control
• You remain solely responsible for the safety of your vessel, crew, and anyone affected by your anchoring
• The app should be used alongside, not instead of, appropriate anchor watch procedures

3. In-App Purchases

The Lifetime tier is available as a one-time in-app purchase processed through the Apple App Store. All purchases are subject to Apple's terms and conditions. Refund requests must be submitted directly to Apple via reportaproblem.apple.com.

Lifetime access is tied to your Apple ID and can be restored on other devices through the standard App Store restore mechanism.

4. Remote Watch

The Remote Watch feature allows a third party to observe your vessel's position in real time. By enabling this feature you accept that:

• Anyone with your watch code can view your position during an active session
• You are responsible for who you share your watch code with
• The feature depends on internet connectivity on both devices — we cannot guarantee uninterrupted service

5. Availability and Updates

We aim to keep HoldFast available and up to date but do not guarantee uninterrupted access to the app or any connected services. We reserve the right to modify, suspend, or discontinue any part of the app at any time. Where possible we will provide notice of significant changes.

6. Intellectual Property

All content within the app and on this website — including the HoldFast name, logo, design, and code — is the property of Latitude 49 Design and is protected by applicable intellectual property law. You may not reproduce or distribute any part of it without our written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Latitude 49 Design shall not be liable for any loss, damage, or injury — direct or indirect — arising from your use of HoldFast. This includes but is not limited to vessel damage, personal injury, loss of property, or any consequence of an alarm failing to trigger.

The app is provided "as is" without warranty of any kind, express or implied.

8. Governing Law

These terms are governed by the laws of Scotland, United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.

9. Changes to These Terms

We may update these terms from time to time. The date at the top of this page will reflect the most recent revision. Continued use of the app after changes constitutes acceptance of the updated terms.
